The Australian government has announced a welcome change for Prospective Marriage visa holders stuck outside of Australia. Typically a Prospective Marriage visa (subclass 300) requires a person to enter Australia and marry their Australia fiancée or partner within 9 months.

The COVID-19 pandemic has meant that many people were unable to enter Australia and marry before their 9 month visa expiry. To resolve this terrible situation, the Australian government has announced if you meet the following two requirements, your Prospective Marriage visa will be extended to 31 March 2022:

  • You hold a Prospective Marriage visa (subclass 300) between 6 October 2020 and 10 December 2020 AND
  • You were outside Australia on 10 December 2020, your visa expiry has been extended.

If you are unclear if this change affects you we recommend you book in for a free 10 minute phone call with one of our lawyers. It may also be worth exploring on this call if you another visa pathway such as an Offshore Partner visa (subclasses 309/100) may be worth considering.
